EU settlement scheme

Some people can still apply for the EU settlement scheme after the deadline. 

The deadline to apply for the EU settlement scheme in the UK was June 30th, 2021. However, to some people, this deadline doesn’t apply. The people who can apply for a pre-settled or a settled status after the 30th June deadline are the following:

  • Family members of someone who is from the EU or qualifying countries*, and moved to the UK by 31 December 2020, and you joined them in the UK on or after 1 April 2021.
  • Applying for your child who was born or adopted in the UK on or after 1st April 2021.
  • If you are an individual who is exempt from immigration control or stopped being in immigration control after June 30th.
  • If you have a Visa that expires after the 30th June 2021.
  • A family member of an individual who lived in the EU or qualifying countries*- you must have lived with them in that country by 30th December 2020 and returned to the UK with them.

When do you need to apply? 

There is a series of circumstances during which you may need to apply for a pre-settled or a settled status when coming to the UK, these include:

  • If you are applying as a family member of a British Citizen, who you lived within the EU or the other qualifying countries*, the deadline for this application is 29th March. If you would like assistance with this, contact our immigration experts now.
  • If you have limited leave or enter the UK, which expires after the 30th of June, this application must be made until your leave expires. If you were unable to do so, you must provide evidence as to why you weren’t able to do so.
  • You do not have to apply if you are under immigration control. However, you can if you decide to do so. If you are no longer exempt, you have 90 days to apply.
  • As a joining family of someone already in the UK, you have 90 days to apply. This only applies if you join your family on or after April 1st.
  • If you are applying for a child who was born or adopted on or after April 1st, 2021, meaning you have 90 days after the date they were born or adopted.
  • If you are a family member or an eligible member* of northern Ireland and they couldn’t go back to the UK before the deadline, meaning you have 90 days to apply since you arrive.

Who is eligible to apply for the EU settlement scheme? 

There is a range of factors that make you eligible to apply for the settlement scheme, these include:

  • If you came to the UK before the 31st December 2020 from the EU or one of the eligible countries*.
  • You are the family of someone from the EU or eligible countries* and started living in the UK before the 31st December 2021.

You also may be eligible if:

  • You are a family member of a frontier worker.
  • You are a family member of someone under immigration control.
  • You’re the child of someone who is an EU citizen or eligible country*, who used to live and work in the UK, and you must be in education in the UK.
  • You’re a family of a British Citizen and an EU or eligible country* citizen who used to live in the eligible country*.
  • If you have a family member who is an eligible person of northern Ireland.
  • You used to have a family member who was an EU citizen or eligible country* who started living in the UK before 31st December.
  • You are the family member of someone who is a British Citizen, who you lived within the EU or eligible country*; you must have come back to the UK with them to apply.
